By accessing or using Kalen (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Kalen is an AI-powered accountability coaching service that helps users set and track weekly goals through email-based interactions. The Service includes:

  • Weekly goal-setting prompts
  • Daily check-in emails
  • AI-generated coaching responses
  • Progress tracking

3. AI Limitations and Disclaimers

IMPORTANT: Kalen uses artificial intelligence which may make mistakes. You acknowledge that:

  • AI-generated content may contain errors or inaccuracies
  • You should verify any important information independently
  • Kalen is not a substitute for professional medical, financial, legal, or psychological advice
  • The Service is for general accountability and productivity purposes only
  • AI responses are not personalized professional advice
  • You are solely responsible for your own actions based on AI suggestions
  • We do not guarantee any specific results or outcomes from using the Service
  • Individual results will vary based on personal effort and circumstances

4. User Accounts

To use Kalen, you must:

  • Provide a valid email address
  • Be at least 18 years old
  • Maintain the confidentiality of your account
  • Notify us immediately of any unauthorized use

5. Pricing and Payment

  • 30-day free trial with no credit card required
  • After trial: $10/month or $100/year
  • Prices may change with 30 days notice
  • All payments are processed securely through our payment provider

6. Cancellation and Refunds

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of your current billing period
  • No refunds for partial months/years
  • Email us or click unsubscribe to cancel

7. Email Delivery

While we strive for reliable email delivery, you acknowledge that:

  • We cannot guarantee that emails will reach your inbox
  • Emails may be filtered by spam filters or blocked by email providers
  • You are responsible for whitelisting our email addresses
  • You should check your spam/junk folder regularly
  • We are not liable for missed check-ins due to email delivery issues

8. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Harass, abuse, or harm others
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service
  • Use the Service to generate spam or malicious content

9. Privacy

Your use of the Service is also governed by our Privacy Policy. We take your privacy seriously and only use your data to provide and improve the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KALEN AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Indemnification

You agree to indemnify and hold harmless Kalen and its affiliates from any claims, losses, damages, liabilities, and expenses arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes via email. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Arbitration Agreement

PLEASE READ THIS CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

You and Kalen agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration, except that each party retains the right to bring an individual action in small claims court. You acknowledge and agree that you are waiving the right to a trial by jury. The arbitration shall be commenced and conducted under the Commercial Arbitration Rules of the American Arbitration Association (“AAA”) and, where appropriate, the AAA's Supplementary Procedures for Consumer Related Disputes (“AAA Consumer Rules”), both of which are available at the AAA website www.adr.org.

The arbitration will be conducted in the United States county where you live or work, San Francisco, California, or any other location we agree to. The arbitrator's decision shall be final and binding on all parties.

15. Class Action Waiver

YOU AND KALEN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Kalen agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

16. Governing Law

These Terms shall be governed by the laws of the United States and the State of California, without regard to its conflict of law provisions.
